3. Client Responsibilities

As a client, you agree to:

  • Cooperate fully with our investigation and recovery efforts
  • Provide all relevant documentation and evidence in a timely manner
  • Respond promptly to requests for information or action
  • Not engage directly with perpetrators without our prior approval
  • Maintain confidentiality regarding case strategy and ongoing investigations
  • Pay all agreed-upon fees and expenses as outlined in the engagement agreement

4. Fees and Payment

4.1 Contingency Fee: Most cases are handled on a contingency fee basis (typically 25-35% of recovered funds). You pay only if we successfully recover your assets.

4.2 Fixed Fee: Complex cases may require a fixed fee arrangement, which will be clearly outlined in the engagement agreement.

4.3 Retainer: Some cases may require an upfront retainer to cover initial investigative costs. This will be discussed during consultation.

4.4 Additional Expenses: Clients are responsible for third-party expenses such as court filing fees, wire transfer fees, or expert witness costs, which will be approved in advance.

5. No Guarantees

While we employ proven methods and extensive experience, we cannot guarantee specific outcomes or complete recovery of lost funds. Success depends on numerous factors including:

  • Timing and speed of reporting
  • Availability and quality of evidence
  • Cooperation of financial institutions
  • Jurisdictional complexities
  • Perpetrator identification and asset availability

We provide honest assessments of recovery potential and work diligently to maximize your recovery chances.

6. Confidentiality

We maintain strict confidentiality regarding all client information and case details. All team members and partners are bound by non-disclosure agreements. We will not disclose your information except as required by law or with your explicit permission to pursue recovery efforts.

7. Engagement and Termination

7.1 Engagement: Services begin upon signing a formal engagement agreement that outlines scope, fees, and terms specific to your case.

7.2 Client Termination: You may terminate services at any time with written notice. Fees owed for work completed up to termination date are due and payable.

7.3 Company Termination: We reserve the right to terminate services if: (a) client fails to provide necessary information or cooperation, (b) client engages in illegal activities, (c) fees remain unpaid, or (d) continued representation would violate ethical or legal obligations.

8. Limitation of Liability

To the fullest extent permitted by law, Asset Recovery Solutions shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, or data
  • Damages exceeding the fees paid for our services
  • Actions or decisions of third parties including financial institutions, law enforcement, or courts
  • Delays or failures due to circumstances beyond our reasonable control

9. Intellectual Property

All content, methodologies, strategies, and materials developed by Asset Recovery Solutions remain our intellectual property. You may not reproduce, distribute, or disclose such information without our written permission.

10. Dispute Resolution

10.1 Mediation: Any disputes shall first be attempted to be resolved through good-faith mediation.

10.2 Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

10.3 Governing Law: These terms are governed by the laws of the State of New York, without regard to conflict of law principles.

11. Indemnification

You agree to indemnify and hold harmless Asset Recovery Solutions from any claims, damages, or expenses arising from: (a) your breach of these terms, (b) your violation of any law or rights of third parties, (c) false or misleading information provided by you, or (d) your unauthorized actions taken without our guidance.

12. Electronic Communications

By using our services, you consent to receive electronic communications from us. These communications may include notices, agreements, and information about your case. You agree that electronic communications satisfy any legal requirement for written communication.

13. Modification of Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement
